Jim’s Bathrooms & Resurfacing (Australia) (ABN 12 663 495 163, hereafter referred to as ‘Jim’s Bathrooms’ or ‘We’ or ‘Us’ or ‘Our’ or the Promoter) is hosting a promotional event (hereafter referred to as the ‘Contest’ or ‘Giveaway’ or ‘Promotion’) aimed at Individuals (referred to as ‘Participant’ or ‘Entrant’ or ‘Member’ or ‘They’ or ‘Them’ or ‘You’ or ‘your’).

The promotion is scheduled to commence from March 1st, 2025, 12:00am AEST, to March 31st, 2023, 11:59pm AEST. The giveaway event will occur live on social media at 6:00pm on April 3rd, 2025. The prize drawing will take place at 48 Edinburgh Rd, Mooroolbark VIC 3138. The fortunate Winner will be promptly contacted via phone, SMS, and email.

Here are the conditions for participation in the giveaway:

Entrants must purchase a package through jimsbathrooms.com.au or our official social media links for automatic entry into the giveaway. Packages can be purchased via the link provided in our ads or on our website. The initial contest draw on April 3rd, 2025, will take place at 6:00PM AEST at the Jim’s Group head office. Our total prize pool is valued at $31,250.00, comprising:

• 1st Prize: Complete Bathroom Renovation – Valued at $30,000.00
• 2nd Prize: $750.00 Eftpos Voucher
• 3rd Prize: $500.00 Eftpos Voucher

The Winner will be announced on social media at 6:00pm and listed on our Website, Instagram, and Facebook on the same day. Winners’ details will be available at jimsbathrooms.com.au.

In the event of a prize remaining unclaimed after 90 days, a redraw will occur on July 2nd, 2025, 12:00PM AEST, at 48 Edinburgh Rd, Mooroolbark VIC 3138. The new winner will be announced on our Website, Instagram, and Facebook on the same day. Winners’ details will be available at jimsbathrooms.com.au.

The giveaway will be conducted under official scrutiny in accordance with state laws governing promotional giveaways.

For fairness, individuals associated with Jim’s Bathrooms, its directors, or employees are ineligible to participate in the giveaway. Additionally, any parents, affiliates, friends, subsidiaries, or related companies including contractors or subcontractors are not eligible to win any prizes. Should any known individual or company associated with Jim’s Bathrooms win, their entry will be considered invalid, they will receive a full refund, and a new winner will be drawn from the remaining entrants.

Bathroom renovation will commence within 90 days of the promotion’s conclusion. This allows us time to source tiles, fixtures, and fittings, schedule trades, and allocate time for the design consultation for your new bathroom. This promotion is not valid in ACT & SA.

Jim’s Bathrooms will cover all costs associated with completing the bathroom renovation. All package purchases are final and non-refundable. Each package purchase is a one-time payment and does not imply a subscription to any product or service. Every individual entry holds an equal chance of winning compared to any other.

10% Discount:

• The timeframe to access the 10% discount on bathroom renovation services depends on the package purchased, as outlined in the package inclusions.
• The quotation and on-site inspection will be conducted only after the package has been purchased, not beforehand.
• A deposit must be paid within this period to qualify for the discount.

Included with the Prize:

Jim’s Bathrooms is pleased to announce that in addition to awarding fantastic prizes, we will cover additional expenses related to the win, including asbestos removal (if any) and new structural flooring for the bathroom.

Cancellation of Service:

Limitation of Liability:

In no event shall Jim’s Bathrooms or any party acting on its behalf be liable for claims, proceedings, liabilities, obligations, damages, losses, or costs exceeding the specified limit. By agreeing to these terms, you waive rights to claim punitive or other damages beyond actual out-of-pocket expenses.

Indemnity:

You agree to indemnify, defend, and hold harmless Jim’s Bathrooms, its directors, officers, employees, and affiliates from claims, damages, liabilities, or expenses arising from these Messaging Terms or text messages.

Dispute Resolution:

Any disputes arising from these Messaging Terms shall be resolved by binding arbitration, waiving the right to a trial by jury or participation in a class action.

Exceptions:

Notwithstanding, certain exceptions apply for small claims court actions, enforcement actions through agencies, seeking injunctive relief, or addressing intellectual property infringement claims.

Arbitrator: Arbitration will be governed by JAMS, under the Optional Expedited Arbitration Procedures. The arbitrator has exclusive authority to resolve disputes related to this agreement.

No Class Actions: Both parties agree not to bring claims against each other in a representative capacity. The arbitrator may not consolidate claims or preside over representative proceedings unless mutually agreed upon.

Modifications to Arbitration Provision: You may reject changes to this arbitration provision by sending written notice within 30 days. Otherwise, the updated provision will govern disputes.

Enforceability: If any provision of these Messaging Terms is found unenforceable, the remainder shall remain in effect.

Changes to Messaging Terms:

We reserve the right to change or cancel the Messaging Terms, which you accept by continuing to receive messages from Jim’s Bathrooms after changes are made.

Entire Agreement/Severability:

These Messaging Terms, along with any amendments or additional agreements, constitute the entire agreement.

• The bathroom renovation involved in this contest is owned and funded by Jim’s Bathrooms & Resurfacing (Australia) and will be given away as a promotional prize.
• The purpose of this contest is to promote Jim’s Bathrooms and bring awareness to the Jim’s Bathrooms brand.
• We do not sell raffle tickets, or any other form of ticket to enter this giveaway.
• This prize is strictly a promotional giveaway, which can be won by any person that purchases a bundle via our website or any official link, thereby becoming a customer of Jim’s Bathrooms.
• Entries to the giveaway are strictly, and only provided as promotional prizes to the members or customers of Jim’s Bathrooms.
• Entries cannot be purchased and will not be sold separately.
